Gym User Terms & Conditions

1. PARTIES

This agreement is between Silverbacks Fitness Ltd ("the Gym") and the individual named in the digital sign-up portal ("the Member").

You the member agree to the ‘gym rules’ upon entering the property and respect other members. The gym rules can be found on the your member portal and on the website. 

You agree you have considered your own personal fitness requirements and will exercise within your own abilities, taking into consideration any disabilities which you may have and agree to train at your own risk. You accept that the gym is not always staffed during all opening hours and that it is your personal responsibility to stop exercising if you feel ill or require assistance.

 

2. 24-HOUR UNMANNED ACCESS & RISK

  • Unmanned Hours: The Member acknowledges that the Gym is unmanned during specific hours. No staff will be present to provide assistance, medical intervention, or supervision.

  • Assumption of Risk: The Member voluntarily assumes all risks of injury, accident, or death that may occur while training alone.

  • Emergency Protocols: The Member agrees to familiarize themselves with the location of emergency "Panic Buttons" and the use of the alarms provided by the Gym. Failure to use these safety measures is at the Member's own risk.

 

3. KISI DIGITAL ACCESS

  • Credentials: Access is granted via the KISI system on the Member’s smartphone. Access is non-transferable.

  • Mobile Responsibility: The Gym is not liable for access issues due to phone battery failure, lack of data, or hardware issues.

  • The "Digital Footprint": Every "Unlock" is logged with a timestamp linked to your identity and will be used as definitive evidence of your presence.

  • Strict No-Tailgating Policy: The Member must scan their KISI app for every entry. Allowing any other person (member or non-member) to enter the premises using the Member’s credentials is a material breach of contract.

  • Indemnity for Guests: If you allow a non-member to enter, you accept full legal and financial responsibility for their actions and any injuries they sustain.

  • Unauthorized Entry Fee: If the Member facilitates unauthorized entry, they agree to pay a £50 penalty fee and face immediate membership termination.

 

4. UPSTAIRS FACILITIES & RESTRICTIONS

  • Permitted Areas: Membership grants access to the ground-floor gym floor and the designated upstairs changing rooms and toilets only.

  • Prohibited Areas: The Member is strictly prohibited from entering the upstairs Martial Arts mat area and training zones.

  • Separate Entity: The Member acknowledges that the Martial Arts club is a separate business. The Gym is not liable for any interactions or incidents occurring between Gym members and Martial Arts club participants in shared areas.

 

5. LIABILITY & INDEMNITY

  • Waiver of Liability: To the fullest extent permitted by law, the Gym shall not be liable for any injury, loss, or damage to person or property. This includes, but is not limited to, injuries arising from the use of equipment, slips/falls in shared changing areas, or the actions of other members.

  • Indemnity: The Member agrees to indemnify and hold harmless the Gym against any claims, costs, or legal fees resulting from the Member’s breach of this agreement or misuse of the facility.

 

6. CONDUCT & TERMINATION

  • Revocation at Will: The Gym reserves the right to terminate or suspend this membership at its sole discretion and without notice for any conduct deemed unsafe, inappropriate, or in breach of these terms.

  • CCTV Evidence: The Member consents to 24/7 CCTV monitoring. CCTV and KISI logs will be used as the primary evidence for any termination decisions or liability disputes.

·       There is no option available to pause an annual membership and all annual memberships are non refundable.

  • We do not accept any cancellation requests verbally.  All cancellation requests are to be submitted via our cancellation form and sent to our email.  The cancellation of your direct debit or bank card will not cancel your membership and your payments will continue until you have followed the correct cancellation procedure as stated above. All cancellation requests will receive an email confirmation within 7 working days. It is your responsibility to check you have received the confirmation and to check your bank for any future payments.

7. HEALTH & PHYSICAL CONDITION

The Member warrants that they are in good physical health and have no medical conditions that would make training alone dangerous. The Member is encouraged to seek medical advice before beginning any new exercise program.

You must provide the gym with an emergency contact in case of emergencies.

8. FEES, CANCELLATION & THE "COOLING-OFF" PERIOD

8.1 Membership Fees

  • Monthly Subscription: The membership fee is £30.00 per month, payable in advance via Direct Debit or recurring card payment.

  • Price Changes: The Gym reserves the right to increase fees. You will be given at least 30 days' written notice of any price increase. If you do not agree to the new fee, you have the right to cancel without penalty before the increase takes effect.

8.1.2 Joining Fee

  • A joining fee of £10 is payable upon sign-up.

  • This fee covers the administrative costs of setting up your KISI profile and digital security credentials.

  • The Joining Fee is strictly non-refundable, including cases where membership is terminated for breach of terms or cancelled by the member after the statutory 14-day cooling-off period.

8.2 Statutory 14-Day "Cooling-Off" Period

  • If you joined online or over the phone, you have a legal right to change your mind within 14 days of signing up.

  • If you use the gym during this 14-day period and then cancel, we reserve the right to charge a pro-rata fee for the days the membership was active, plus a reasonable administration fee for KISI setup.

    1. Monthly Subscription & Late Fees

  • The membership fee is £30.00 per month, payable in advance.

  • Late Payment Fee: If a monthly payment fails or is not received by the due date, a £15.00 late payment fee will be automatically applied to your account.

  • Access Suspension: Your KISI digital access will be instantly suspended if any payment (including late fees) remains outstanding. Access will only be restored once the account is settled in full.

·       MEMBERSHIP FREEZE. I have the right to freeze my membership for a minimum of one month and up to three months per year, during which time I will pay a processing charge of £4 per month. I must provide written notice at least five days in advance of my next billing cycle and your membership costs for that month must be paid in full prior to freezing. A membership cannot be cancelled during a freeze period.

 

8.3 Cancellation Policy

  • Monthly Rolling Contract: This is a monthly rolling agreement. You may cancel at any time by providing one full calendar month’s notice.

  • How to Cancel: To ensure transparency, cancellations must be submitted via email to info@silverbacksfitness.co.uk.

    • Example: If you cancel on the 15th of May, your notice period covers June, and your membership will end on the 30th of June.

  • Direct Debit: Simply cancelling your Direct Debit does not constitute a legal cancellation of this contract. You remain liable for any fees due during your notice period.

8.4 Late Payment & Failed Charges

  • Admin Fee: If a payment fails (e.g., insufficient funds), our system will automatically re-attempt collection. A £15.00 administration fee will be applied to each failed attempt to cover the costs of bank charges and manual processing.

  • Access Suspension: Your KISI digital key will be automatically deactivated immediately if a payment is missed. Access will only be restored once the outstanding balance, including admin fees, is paid in full.

8.5 Debt Recovery

Unpaid fees beyond 30 days may be referred to a third-party debt collection agency. You will be liable for all costs associated with the recovery of the debt, including legal fees and agency commissions. If collection or legal services are needed to collect any unpaid amount, I am responsible for all costs of collection, including solicitor’s fees of Club Owner. 

If you die or become totally or permanently disabled, upon reasonable written notice to the Club with proof of the death or disability, either you or your estate may cancel this Agreement and receive a prorated refund of the unused portion of membership fees incurred.

 

9.1 Age Restriction & Verification

  • Minimum Age: "Membership is strictly limited to individuals aged 16 years and older. By signing this agreement, the Member warrants that they are at least 16 years of age."

  • Proof of Age: "The Gym reserves the right to request official government-issued photo identification (Passport or Driver’s License) to verify age. Access will be suspended until age is verified."

 

9.2. Parental/Guardian Consent 

Co-Signature: Members aged 16 or 17 must have this Agreement and the Liability Waiver co-signed by a parent or legal guardian. The parent/guardian agrees to be responsible for the minor’s conduct and any financial obligations (membership fees) incurred."

  • Indemnity: The parent/guardian agrees to indemnify Silverbacks Fitness Ltd against any claims arising from the minor’s use of the facility or breach of these terms.

9.3. Unmanned Hours & Lone Training for Minors

  • Risk Acknowledgement: "Parents/Guardians of 16 and 17-year-old members explicitly acknowledge that the Gym is unmanned during specific hours. By allowing the minor to join, the parent/guardian accepts the risk of the minor training without professional supervision. No minor is allowed access into the gym after 22:00, their KISI system will restrict entry automatically. 

  • Emergency Contact: Members under 18 must provide a valid emergency contact number for a parent or guardian that is reachable during the hours the minor is training.

9.4. Code of Conduct & Zero Tolerance

  • Professionalism: Teenage members are expected to adhere strictly to the gym rules. 'messing around,' abusive, intimidating behaviour or filming other members will result in immediate membership termination and KISI deactivation without a warning.

9.5. Membership Type Restriction

  • Direct Debit: If the Member is under 18, the Direct Debit or recurring payment must be set up via a parent or guardian’s bank account.

 

FACILITIES AND SERVICES. The Club reserves the right at any time to delete, discontinue, repair or replace the facility equipment without any effect on this Agreement. The Club may be closed for up to two weeks each year for maintenance purposes.

SLIP/TRIP HAZARDS: Shared changing areas are high-traffic zones. The Gym is not liable for slips/falls due to wet floors; members are advised to wear indoor footwear (e.g., flip-flops).

NO STEROIDS. I understand that the Club bans the use of steroids and I agree not to use, sell or exchange steroids on the Club’s premises. 

PHYSICAL CONDITION AND NO MEDICAL ADVICE. I confirm that I am in good physical condition and have no medical reason or impairment that would prevent me from my intended use of Silverbacks Fitness facilities. I understand and acknowledge that the Club Owner and Licensor will not and cannot provide me with any medical advice. If I have any health or medical concerns now or after I join, I will discuss them with my doctor before using the facilities.

GUEST REQUIREMENTS. I understand I may be expected to show proper identification when I enter the facility.

RULES AND REGULATIONS. I agree to follow any club rules posted at the gym or communicated by club staff. The gym may, in its sole discretion, modify its rules or policies without notice at any time. 

HYGIENE & EQUIPMENT: Members must wipe down machines after use and return all weights to designated racks.

FIRE PROCEDURE. You agree not to use, block or interfere with fire, emergency or disabled access doors or alarms, except in a genuine emergency. You should ensure you are familiar with the fire exits and extinguishers in the gym and the rendezvous point (found in the car park). In the unlikely event of a fire you agree to leave the faciality immediately and not enter again unless told it is safe to do so by a member of staff. 

LIABILITY FOR PROPERTY. The Club Owner is not liable to me for any personal property that is damaged, lost or stolen while on or around Club premises including, but not limited to, a vehicle or its contents or any property left in a locker. If I cause any damage to the Club, I am liable to the Club Owner for the cost of repair or replacement.

VIDEO NOTICE. I may not take unauthorized photos or videos anywhere in the Club. I understand that the Club uses unmonitored video surveillance and access card usage is logged, which both may be retained by the Club for future use.

DATA PROTECTION

We will deal with all information we hold about you in line with our privacy policy which you can get from our Website. If you want to know what information we hold about you, or you want us to correct any information we hold about you, the appropriate procedures are set out in our privacy policy.

WAIVER OF LIABILITY: To the fullest extent permitted by law, the Gym is not liable for any injury, loss, or damage to person or property (including lockers and vehicles).
